Around 241,000 Uber drivers across Europe and the UK are represented in a landmark collective action filed in Amsterdam over AI-driven pay and job allocation.
Drivers allege Uber’s opaque algorithm profiles their behaviour to determine the lowest fare an individual driver may accept, potentially offering different pay for the same trip.
The lawsuit claims this amounts to unlawful automated decision-making and profiling under GDPR, and alleges driver data was also unlawfully used to train AI models.
UK drivers claim dynamic pricing has reduced their annual earnings by roughly £5,000, while the system was introduced in the Netherlands this year.
Uber rejects the allegations, saying individual acceptance/rejection behaviour is not used to personalise pay, setting up a major European test of transparency and accountability in algorithmic management.
